If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian. Users under 13 are strictly prohibited from creating accounts or using the Service.
You agree to provide accurate, current, and complete information during registration. You must maintain and promptly update your account information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must immediately notify us of any unauthorized use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to maintain account security. You may not share, sell, or transfer your account to any other person or entity.
You agree not to post, share, or link to content that:
Adult content (NSFW) is permitted but must be properly marked using our NSFW tagging system. Failure to appropriately tag adult content may result in account suspension. All NSFW content must comply with applicable laws and must not contain illegal material. Content involving minors in sexual contexts is strictly prohibited and will result in immediate account termination and reporting to authorities.
Usernames must not be offensive, misleading, or impersonate others. We reserve the right to reclaim or reassign usernames that violate this policy or are inactive for extended periods. Reserved usernames include those of our staff, official accounts, and generic terms deemed necessary for platform operations.
You retain ownership of all content you post to the Service ("Your Content"). By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute Your Content in connection with operating and providing the Service.
The Service, including its design, features, graphics, and code, is owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.
We respect intellectual property rights and expect our users to do the same. If you believe your copyright has been infringed, contact us at legal@gotchya.lol with: (1) identification of the copyrighted work, (2) identification of the infringing material, (3) your contact information, (4) a statement of good faith belief, and (5) a statement of accuracy under penalty of perjury. We may terminate accounts of repeat infringers.
gotchya.lol offers free and premium subscription tiers. Premium features, pricing, and billing cycles are described on our pricing page. Prices are subject to change with 30 days notice to existing subscribers.
Payments are processed through third-party payment processors. You agree to their terms and conditions. We do not store your complete payment information. You authorize us to charge your payment method for all fees incurred under your account.
Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms. If we terminate your account for violations, you forfeit any remaining subscription period without refund.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that time.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, use, and share your data as described in the Privacy Policy.
We collect analytics data including IP addresses, device information, browser type, operating system, pages visited, links clicked, and usage patterns. This data helps us improve the Service and detect fraudulent activity.
By using the Service, you consent to our data collection practices as described in our Privacy Policy, including the use of cookies and similar tracking technologies.
We employ both automated systems and human moderators to enforce these Terms. We reserve the right to review, flag, hide, or remove any content at our discretion. Content moderation decisions may be appealed by contacting support@gotchya.lol.
We may take the following actions for Terms violations:
You may appeal moderation decisions within 30 days by emailing appeals@gotchya.lol with your account details and explanation. We will review appeals within 7 business days. Our decision on appeals is final.
The Service allows you to link to third-party websites and services. We are not responsible for the content, privacy practices, or availability of third-party sites. Your interactions with third-party sites are solely between you and that third party.
Links to third-party sites do not constitute endorsement by us. You access third-party sites at your own risk. We encourage you to review the terms and privacy policies of any third-party sites you visit.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR CONTENT; (C) THIRD-PARTY CONDUCT OR CONTENT ON THE SERVICE; OR (D) ANY OTHER MATTER RELATING TO THE SERVICE.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
You agree to indemnify, defend, and hold harmless gotchya.lol, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) Your Content.
Before filing a formal dispute, you agree to contact us at legal@gotchya.lol to attempt informal resolution. We will attempt to resolve disputes in good faith for 60 days.
If informal resolution fails, disputes will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify. The Federal Arbitration Act governs the interpretation and enforcement of this provision.
YOU AND gotchya.lol AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
You may terminate your account at any time by accessing your account settings and selecting "Delete Account." Upon deletion, your profile and public content will be removed. We may retain certain data as required by law or for legitimate business purposes.
We may suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. We may also terminate or suspend the Service entirely at our discretion.
Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and us regarding the Service.
If any provision of these Terms is found to be unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
You may not assign or transfer these Terms or your account to any other person or entity. We may assign our rights and obligations under these Terms without restriction.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
